Staying in compliance with local, state and federal regulations while ensuring your insurance company’s right to inspect requires both an immediate response and, to some degree limited work being performed until all the i’s can be dotted and t’s crossed.

How we maintain the environment during those investigations is often challenged by insurance companies. We think you should understand what we must do and will help you identify the conditions your contractor should be maintaining upfront so we can eliminate disagreements at the end.

How Asbestos (ASB) Affects You:
Asbestos is a known hazard and can be very dangerous (ie deadly – Mesothelioma and Asbestosis) to those exposed to it.  If present, a licensed Asbestos abatement contractor is required to remove Asbestos. Please note, Asbestos is ONLY an issue if building materials are being disturbed.

What You Should Know:

• Pre 1982 Structures - Federal Asbestos Regulations requires the contractor to PRESUME Asbestos is present and if not properly licensed, to use a licensed abatement contractor for any and all demo OR sample for Asbestos to confirm it is not present.

• Post 1982 Structures - Regardless of age, OSHA requires that all contractors protect their workers and any occupant from any present hazard, Including Asbestos. Asbestos remains in use currently and is a naturally occurring mineral fiber in many construction materials.  It is in over 25% of new structures we survey.  As such, your contractor must again presume Asbestos is present, perform their work according to Federal Regulations or sample to confirm its absence.  Please be aware, testing often confirms there is no Asbestos present. 

Why it Matters to You –

• Asbestos abatement is more expensive than standard demolition, significantly. So, while an upfront cost, sampling may be in your financial interest in the long run. 
• If you presume and do work as though Asbestos is present without sampling, any work you do may not be paid because “you didn’t prove it”.  It happens often.
• Fail to sample and you could cross contaminate your whole house and all your contents.
• You ultimately are left holding the bag when things go wrong.  While you can blame your contractor or carrier, it will be YOU who has to spend your time, energy and money fighting to make things right.

How Lead (PB) Affects You:
Lead is a known hazard and can be very dangerous (ie deadly – Birth defects, etc ) to  those exposed to it.  If present, a licensed Lead abatement contractor is required to remove Lead. Please note, Lead is ONLY an issue if building materials are being disturbed.

What You Should Know:

• Pre 1978 Structures - Federal Lead Regulations requires the contractor to PRESUME Lead is present and if not properly licensed, to use a licensed abatement contractor for any and all demo OR sample for Lead to confirm it is not present.

• Post 1978 Structures - Regardless of age, OSHA requires that all contractors protect their workers and any occupant from any present hazard, Including Lead. Lead remains in use currently. We find it in many new structures we survey.  As such, your contractor must again presume Lead is present, perform their work according to Federal Regulations or sample to confirm its absence.  Please be aware, testing often confirms there is no Lead present.

Silica is a known hazard and can be very dangerous (i.e. deadly - Silicosis) to  those exposed to it.  If present, a licensed Silica abatement contractor is required to remove Silica. Please note, Silica is ONLY an issue if building materials are being disturbed.

What You Should Know:

• Pre 1972 Structures - Federal Silica Regulations requires the contractor to PRESUME Silica is present and if not properly licensed, to use a licensed abatement contractor for any and all demo OR sample for Silica to confirm it is not present.

• Post 1972 Structures - Regardless of age, OSHA requires that all contractors protect their workers and any occupant from any present hazard, Including Silica. Silica remains in use currently and is a naturally occurring mineral fiber in many construction materials.  Silica is almost everywhere: Drywall, Drywall Texture, Concrete, Thinset, Ceramic Tiles, etc.  As such, your contractor must again presume Silica is present, perform their work according to Federal Regulations or sample to confirm its absence. 

• Why it Matters to You –
• Silica abatement is more expensive than standard demolition, significantly. So, while an upfront cost, sampling may be in your financial interest in the long run.

• To Sample or Not to Sample -   Silica sampling/monitoring can be very costly.  We typically find that most carriers will not push back on work practices appropriate for Silica if identified up front.  So, we recommend that direct contact be made with the carrier and to see if they will agree to its, all but ubiquitous, presence on a project and the required  work practices.
